On or about May 8, 2023, employees were engaged in commercial framing construction on a walking/working surface, approximately 11 feet above the next lower level. The employer failed to ensure the employees were protected from falling by use of guardrail systems, safety net systems, or personal fall arrest systems.

29 CFR 1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) At the worksite, 54 West Genesee Street, Camillus, NY 13031, On or about May 8, 2023, employees engaged in framing work on approximately 12 feet above the next lower level were using a portable ladder to access the upper landing surface area. The portable ladder's side rails did not extend at least 3 feet beyond the access point.

On or about June 20, 2023, an employee engaged in commercial framing activities suffered a heat stroke and was hospitalized. The employer failed to report the employee in-patient hospitalization.
