29 CFR 1910.28(c)(3): The employer did not barricade the area into which objects could fall, prohibiting employees from entering the area, and keeping objects far enough away from any edge or opening to prevent them from falling to a lower level: a) Work site - On or about May 8, 2023 and at times prior thereto, employees were stacking tree limbs on the ground within the drop zone, which was not identified by barricades or other means. On May 8, 2023 an employee was struck by a tree limb that had fallen approximately 80' from the tree trimming operations and experienced severe injuries.

29 CFR 1910.135(a)(1): The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects: a) Work site - On or about May 8, 2023 and at times prior thereto, employees working beneath tree felling operations were not equipped with head protection. On May 8, 2023 an employee was struck by a tree limb that had fallen approximately 80' from the tree trimming operations and experienced severe injuries.
