OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to roll-over and tipping hazards of while operating Crown standup forklifts inside of trailers while motor vehicles such as but not limited to tractor-trailers operated maneuvered in forward and in reverse gear: a. DC Production Area, on or about May 9, 2023, and at times prior, employees were exposed to tipping and fall hazards in that a worker assigned to unload door #803 on the loading dock was operating a Crown standup forklift inside of tractor-trailer when the tractor-trailer pulled away from the dock prematurely due to lack of communication.

29 CFR 1910.157(g)(1): Where the employer has provided portable fire extinguishers for employee use in the workplace, the employer shall also provide an educational program to familiarize employees with the general principles of fire extinguisher use and the hazards involved with incipient stage fire fighting. On May 9, 2023, at DC Production Area, the employer did not implement a training program for employees in the use of fire extinguishers for incipient level fires.
