29 CFR  1910.252(a)(2)(iv): Cutting or welding was permitted in areas before the areas were inspected by the individual responsible for authorizing cutting and welding operations:  (a)Hearthside Food Solutions, LLC at One Devil Food Drive, North Sioux City, SD 57049: On or about and at times prior to April 22, 2023, the employer did not ensure employees were protected from fire hazards in that hot work was permitted to be performed on the baghouse of Sugar Silo #1 without being inspected by the individual responsible for authorizing the work. This condition exposed employees to fire and explosion hazards.

29 CFR  1910.252(a)(2)(v): Where combustible materials  were on the floor, the employer did not ensure that the floor was swept clean for a radius of 35 feet (10.7 m) from the cutting or welding operation:  (a)Hearthside Food Solutions, LLC at One Devil Food Drive, North Sioux City, SD 57049: On or about and at times prior to April 22, 2023, the employer did not ensure that employees were protected from fire and explosion hazards in that the floor around the hot work operations was swept clean for a radius of 35 feet prior to hot work being performed. This exposed employees to fire and explosion hazards.

29 CFR  1910.252(a)(2)(vi)(C): Cutting or welding was permitted in the presence of explosive atmospheres (mixture of flammable gases, vapors, liquids, or dusts with air), or explosive atmospheres that could develop inside uncleaned or improperly prepared tanks or equipment which had previously contained such materials, or that could develop in areas with an accumulation of of combustible dusts:  (a)Hearthside Food Solutions, LLC at One Devil Food Drive, North Sioux City, SD 57049: On or about and at times prior to April 22, 2023, the employer did not ensure employees were protected from fire and explosion hazards in that hot work to repair a crack on the exterior wall of  the bag house of Sugar Silo #1  was performed prior to accumulations of combustible dust being cleaned from the interior of the baghouse. This condition exposed employees to fire and explosion hazards.

29 CFR  1910.307(c): Equipment, wiring methods, and installations of equipment in hazardous (classified) locations were not intrinsically safe, approved for the hazardous (classified) location, or safe for the hazardous (classified) location:  (a)Hearthside Food Solutions, LLC at One Devil Food Drive in North Sioux City, SD 57049: On or about and at times prior to April 22, 2023, the employer did not ensure employees were protected from fire and explosion hazards in that the bin indicator housing and conduit for Flour Silo #1 (00717) was not maintained in operable condition. The housing and conduit was damaged that can allow intrusion of dust into the component and exposed the wiring to the ambient atmosphere. This condition exposed employees to fire and explosion hazards.  (b)Hearthside Food Solutions, LLC at One Devil Food Drive in North Sioux City, SD 57049: On or about and at times prior to April 22, 2023, the employer did not ensure employees were protected from electrical and fire hazards in that the bin indicator housing for Flour Silo #2 (00718) was missing a cover, exposing wiring to the ambient environment. This condition exposed employees to electrical, fire and explosion hazards.
