OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by or crushing hazard when operating forklifts without the use of a restraint device in the event of equipment tip over: Location: 344 Brewster Rd., Newark, NJ a. The employer failed to ensure employees operating powered industrial trucks utilized restraint devices when operating the equipment. An employee operated a Caterpillar, Model 2C500, forklift to move pallets throughout the warehouse without using a seatbelt. Violation observed May 9, 2023 b. The employer failed to ensure employees operating powered industrial trucks utilized restraint devices when operating the equipment. An employee operated a Caterpillar, Model GC40k, forklift to move pallets throughout the warehouse without using a seatbelt. Violation observed May 9, 2023

Location: 340 - 344 Brewster Rd., Newark, NJ The employer stored cylinders of Liquefied Petroleum Gas (LPG) in damaged cabinets. Employees deposited and retrieved propane cylinders from outside storage cabinets where the doors to the cabinets were missing and a cabinet had damaged legs and did not protect against tampering. Violation observed 5/ 09/23
