29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet or more above a lower level is protected from falling. a) Mennel Milling Company, on or about May 5, 2023 at the address of 320 Findlay St. Fostoria, OH 44830: The employer failed to ensure that employees were adequately protected from falls when performing work task on top of a rail car. An employee performing loading operation atop the rail car in the aforementioned condition was exposed to a fall of 15 feet to the ground below.
