29 CFR  1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary:  (a) On or about January 05, 2023 and at times prior to  - Building 4, employees were exposed to fall hazards of up to approximately 30 feet when scaffold levels were not fully planked.

29 CFR  1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity):   or in the alternative  29 CFR  1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms before being released for use by employees other than erection/dismantling crews:  (a) On or about January 05, 2023 and prior - Building 4, employees were exposed to fall hazards of up to approximately 30 feet when guardrails were not installed or were partially installed on the ends of the outrigger/sidearm platform between the third and fourth levels of the scaffold on the front of building 4, on the ends of the third and fourth levels of the scaffold on the front of building 4, on the ends of the fourth level of the scaffold at the corner of building 4 on the front of the building (used to access the scaffold from the third floor balcony), and on the ends of the fifth level of the scaffold at the corner on the front and end of building 4 that were connected with a crossover.

29 CFR  1926.451(h)(1): Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects.  For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall:  (a) On or about January 05, 2023 and at times prior to - Building 4, employees were exposed to struck-by hazards when there were no toeboards on the scaffolds when bricks and other materials/items were stacked on the scaffolds.

29 CFR  1926.452(c)(5)(iii): Brackets used to support cantilevered loads were not used only to support personnel, unless the scaffold has been designed for other loads by a qualified engineer and built to withstand the tipping forces caused by those other loads being placed on the bracket-supported section of the scaffold:  (a) On or about January 05, 2023 and at times prior to  - Building 4, employees were exposed to fall hazards of up to approximately 30 feet when the outrigger/sidearm on the top (5th level-approximately 30 feet from the ground) level was used as a location for a concrete tub.

29 CFR  1926.452(c)(2): Tubular welded frames and panels were not braced by cross, horizontal, or diagonal braces, or combination thereof, which would have secured vertical members together laterally:  (a )On or about January 05, 2023 and at times prior to - Building 4, employees were exposed to fall hazards of up to approximately 30 feet when there were no cross braces on the fifth level of the left side of the scaffold located at the end of building 4 at the corner of the building and missing or unattached cross braces on the third level of the scaffold on the front of building 4.
