29 CFR  1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   (a) Back side of the third floor of the hotel: On or about May 10, 2023, and times prior, two employees were observed installing framework on the third story of the hotel. The employees were not using a personal fall arrest system or a fall protection system exposing them to fall up to approximately 30 feet to ground.

29 CFR  1926.502(d)(16)(iii):Personal fall arrest systems, when stopping a fall, shall; be rigged such that an employee can neither free fall more than 6 feet (1.8 m), nor contact any lower level.  (a) On May 10, 2023, and times prior to, an employee was observed on the third story top plate installing sub flooring. The employee used a rope system, however the rope system was of such length that would allow the employee to fall to the floor below.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.  (a) On May 10, 2023 and times prior to, three employees were observed working from heights with inadequate or no fall protection systems.  The employee were not trained in the hazard of falls or fall protections systems.

29 CFR  1926.502(d)(21): Personal fall arrest systems shall be inspected prior to each use for wear, damage and other deterioration, and defective components shall be removed from service.  (a)	On May 10, 2023, and times prior to, the employer did not inspect personal fall arrest systems for damage or defective components. Harnesses were found to have corrosion on the eyelets, buckle connectors,  and frayed fibers exposing employee(s) to potential PPE failure.

29 CFR  1926.95(d)(1): Except as provided by paragraphs (d)(2) through (d)(6) of this section, the protective equipment, including personal protective equipment (PPE), used to comply with this part, was not provided by the employer at no cost to employees.  (a) On May 10, 2023, and times prior to, employees are required use personal protective equipment such as safety glasses, gloves, hard hats, and fall protection harnesses. The employer does not provide the equipment to employees and expect employees to pay for and provide their own protective equipment.
