OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that they were exposed to fall hazards while discharging cottonseed from semi-trailers:  On or about May 11, 2023, employees were exposed to the hazards of falling approximately 10 feet to the ground while discharging cottonseed from semi-trailers.  Among other methods, one feasible and acceptable means of abatement would be to:  1. Comply with OSHA's general industry standards to provide adequate fall protection or fall prevention systems per 29 CFR 1910.28 "Duty to have fall protection" and 29 CFR 1910.140 "Personal fall protection systems"; and, "Fall hazards training requirements" per 29 CFR 1910.30.    2. Follow ANSI/ASSP Z359.2-2017, Minimum Requirements for a Comprehensive Managed Fall Protection Program, Part of the Fall Protection Code, to eliminate and control fall hazards by establishing the fall hazard hierarchy of controls to mitigate fall hazards by:  - Preventing or eliminating exposure to falls by utilizing trailers with walking floors, aerial lifts, scissor lifts and/or ladders to use while discharging cottonseed from semi-trailers.  - Providing a physical barrier between the authorized person and fall hazards. - Providing equipment assembled in such manner that the authorized person cannot fall. - Providing personal fall arrest system (PFAS).
