29 CFR 1926.600(a)(6)(i): For lines rated 50kV or below, a minimum of 10 feet was not maintained between the energized line and the equipment: (a) South side of excavation; A Komatsu model PC490LC-11 excavator was being operated to backfill an excavation when the arm and/or boom of the excavator struck and broke the neutral wire of an energized overhead 3-phase, 7200-volt transmission line.

29 CFR 1926.600(a)(6)(iv): A person was not designated to observe clearance of the equipment and give timely warning for all operations where it is difficult for the operator to maintain the desired clearance by visual means: (a) South side of excavation; A designated spotter/ signal person was not provided and used to warn the excavator operator of hazards presented by overhead electrical hazards while the excavator was being operated in the vicinity of and within the minimum approach boundary of an energized 3-phase, 7200-volt transmission line.
