29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection was not conducted by the competent person prior to the start of work and as needed throughout the shift. These inspections are only required when employee exposure can be reasonably anticipated. a) Glen Valley Road, Petersham, MA: On or about May 12, 2023 and at times prior, employees were exposed to cave-in hazards while working in an unprotected excavation. A daily inspection had not been conducted by a competent person of an unprotected excavation prior to employees entering and working in the excavation.

29 CFR 1926.652(a)(1): Each employee in an excavation were not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: a) Glen Valley Road, Petersham, MA: On or about May 12, 2023 and at times prior, the employer did not provide or require the use of benching, sloping, shoring or other means to ensure that employees working in excavations were protected from cave-in hazards. Employees were exposed to cave-in hazards while working or walking in an unprotected excavation measuring approximately 7'2" in the South West corner of the excavation.
