29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  (a)Brooks Construction Services, Inc., at 2501 West 22nd Street, Sioux Falls, SD 57105: On or about and at times prior to May 9, 2023, the exposing employer did not ensure that an adequate protective system was in place while employees were working within an excavation greater than five feet in depth while conducting concrete form work. This condition exposed employees to cave-in and struck-by hazards associated with excavation wall collapse.

29 CFR  1926.701(b):All protruding reinforcing steel, onto and/or into which employees could fall, was not guarded to eliminate the hazard of impalement:  (a)Brooks Construction Services, Inc., at 2501 West 22nd Street, Sioux Falls, SD 57105: On or about and at times prior to May 9, 2023, the employer did not ensure that protruding reinforcing steel from poured concrete walls was capped or otherwise appropriately guarded.  The condition exposed employees to laceration and impalement hazards associated with accidental contact with exposed protruding reinforcing steel.
