29 CFR  1910.178(a)(4): Modifications and additions which affect the capacity and safe operation of the powered industrial truck were performed by the employer without the manufacturer's prior written approval.  On or about May 11, 2023, and at times prior thereto, employees were utilizing an unapproved nylon sling and chain and hook to remove cardboard bundles that were stuck in the bailer with their Hyster Forklift, exposing employees to a struck-by hazard.

29 CFR  1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s).  On or about May 11, 2023, and at times prior thereto, employees were utilizing a Hyster Forklift with no working strobe light, and the fire extinguisher was zip tied to the rear post of the machine, exposing employees to various hazards while as an operator and while working near other employees.

On or about May 11, 2023, and at times prior thereto, an alloy steel sling was being utilized with no permanently affixed durable identification stating size, grade, rated capacity and reach, exposing employees using the sling to a struck-by hazard.
