Note: The requirements applicable to construction work under this paragraph are identical to those set forth at '1910.178(l) of this chapter.  29 CFR 1910.178(l)(6): The employer did not certify that each operator had been trained and evaluated as required by paragraph (l). The certification did not include the name of the operator, the date of training, the date of the evaluation, and the identity of the person(s) performing the training and evaluation.  A) 605 Horizon Drive Edison, NJ 08817 Building 3  The employer did not ensure that the operator of the JLG 6042 rough terrain forklift had completed training and had the proper documentation of the training. 29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  A)605 Horizon Drive Edison, NJ 08817  Building 3  Fiberglass ladder which was being used to access the 1st floor deck did not extend at least three feet above the upper landing surface of the deck exposing employees to fall hazards. 29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system or personal fall arrest systems:  A) 605 Horizon Drive Edison, NJ 08817  Building 3  Four employees were exposed to fall hazards of up to 12'84' while performing residential framing and decking activities without any fall protection.  Hazards noted on or about 05/12/23  H and M Carpentry was previously cited for a violation of this occupational safety and health standard or its equivalent standard1926.501(b)(13), which was contained in OSHA inspection number 1619206, citation number 1, item number 1 and was affirmed as a final order on 12/15/22, with respect to a workplace located at 201-206 Bally Buion Rd Toms River, NJ.
