29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: (a) On May 16, 2023, at the construction site located on 1500 State Avenue North in Dickinson, ND an employee was exposed to a cave-in hazard when operating a RTSC3 compactor inside a trench with vertical walls measuring 7 feet deep with no protective systems in place.
