On or about May 17, 2023, a worker was observed shingling a residential roof with a pneumatic nail machine without eye or face protection and were not protected from flying particles and/or nails exposing employees to eye injuries and injuries/illnesses associated with flying particles and/or nails.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: On or about May 17, 2023, the employer failed to ensure that portable ladders utilized to access the upper landing surface extended three feet above the edge. Employees were engaged in shingling activities of a residential high slope pitch roof single family two story home. Employees will utilize a portable ladder located at the front of the house to access and egress of the upper landing surface.

Ignacio Correa dba IGC Roofing and Construction, LLC, was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1626877, citation number 1, item number 1 was issued on January 27, 2023, and was affirmed as a final order on March 24, 2023, with respect to a workplace located at 135 S Worthington St Oconomowoc, WI 53066. Ignacio Correa dba IGC Roofing and Construction, LLC, was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 29 CFR 1926.501(b)(13) , which was contained in OSHA inspection number 1611016, citation number 1, item number 1 was issued on December 21, 2022, and was affirmed as a final order on January 20, 2023, with respect to a workplace located at 1132 Oriole Drive, Oconomowoc, WI 53066. Ignacio Correa dba IGC Roofing and Construction, LLC, was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 29 CFR 1926.501(b)(13) , which was contained in OSHA inspection number 1438496, citation number 1, item number 1 was issued on December 11, 2019, and was affirmed as a final order on January 9, 2020, with respect to a workplace located at 132 Grady Dr., Bolingbrook, IL 60440. To abate this violation, the employer must ensure that affected employees use appropriate fall protection when exposed to fall hazards greater than 6 feet in height in the construction industry. Pursuant to 29 CFR 1903.19, abatement certification and documentation are required for this item. The employer's certification that abatement is complete must include [in addition to the requirements in 1903.19(h)], the date and method of abatement and a statement that affected employees have been informed of the abatement. The employer must also submit documents demonstrating that abatement is complete to include, but not limited to, evidence of the purchase or repair of equipment, photographic or video evidence of abatement, or other written records.
