OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm from crushing hazards to employees due to collapse or tip-over of a storage rack system.  (a) Warehouse:  On or about May 17, 2023, an employee loading and unloading batteries for electric bikes from a storage rack system used for charging was exposed to crushing hazards from a collapse or tip-over of the approximate 742.5 pound storage rack system due to unanchored rack columns that affected the stability.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.  Abatement Note: Among other methods, feasible and acceptable abatement methods to correct this hazard are to follow American National Standard Institute (ANSI) and Rack Manufacturers Institute (RMI)-ANSI-RMI MH 16:1-2012, "Specification for the Design, Testing and Utilization of Industrial Steel Storage Racks." Under paragraph 1.4.7 Column Base Plates and Anchors: "The bottom of all columns shall be furnished with column base plates, as specified in 7.1. All rack columns shall be anchored to the floor with anchor bolts, which shall be designed in accordance with Section 7.3, to resist all applicable forces as described in Section 2.1 or Section 2.2."

29 CFR  1910.136(a): The employer did not assure that each affected employee used protective footwear when working in areas where there was a danger of foot injuries due to falling or rolling objects, or objects piercing the sole, and where such employee's feet were exposed to electrical hazards.   (a) Warehouse:  On or about May 17, 2023, employees were exposed to foot injuries when loading and unloading batteries weighing up to 16.5 pounds as a result of not being provided with protective footwear.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1910.157(c)(1): Portable fire extinguishers were not mounted, located and identified so that they were readily accessible without subjecting the employees to injuries.  (a) Warehouse, Bike Shop:  On or about May 17, 2023, employees performing maintenance work on electric bikes were exposed to two unmounted and one partially blocked fire extinguisher in the bike shop.  No abatement certification or documentation required for this item.

29 CFR  1910.303(b)(2): Listed or labeled electrical equipment was not used or installed in accordance with instructions included in the listing or labeling.   (a) Warehouse:  On or about July 11, 2023, an employee loading and unloading batteries from their respective chargers was exposed to two daisy chained 25-foot 12 AWG Well Shin 3 x 3.31mm extension cords that powered the chargers.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
