29 CFR  1926.453(b)(2)(v):  A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under � 1926.502(e).  On or about May 18, 2023 at the new Benton, Arkansas Starbucks, employees were exposed to falling in excess of 10-feet when they used a Ford F-750 crane truck with an aerial lift basket to gain access to the top of the drive through window's awning without tethering themselves inside of the basket.

29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:   a) On or about May 18, 2023, at the new Benton, Arkansas Starbucks, two employees were exposed to a fall distance in excess of 6-feet as they were working from the unguarded top of the drive through window's awning while installing a sign.

29 CFR  1926.502(d)(16)(ii): Personal fall arrest systems, when stopping a fall, did not limit maximum arresting force on an employee to 1800 pounds(8kn) when used with a body harness:  (a)  On or about May 18, 2023 at the new Benton, Arkansas Starbucks, an employee installing a sign while standing on the awning above the drive through window was using a lanyard that lacked a deceleration device that limits the arresting forces as a component of his personal fall arrest system.
