29 CFR 1910.23(b)(2): The employer did not ensure that ladder rungs, steps, and cleats were spaced not less than 10 inches (25 cm) and not more than 14 inches (36 cm) apart, as measured between the centerlines of the rungs, cleats, or steps. a) Verhoff Alfalfa Mills, Inc. On or about May 18, 2023 at the address of 1188 Sugar Mill Dr. Ottawa OH 45875: The employer did not ensure job made fix ladder rungs (steps) were spaced not less than 10 inches and not more than 14 inches apart prior to employees usage. An employee using the ladder in its current condition sustained fall-related injuries from a height of approximately 7 feet to the ground below.

29 CFR 1910.178(a)(4):Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: a) Verhoff Alfalfa Mills, Inc. On or about May 18, 2023 at the address of 1188 Sugar Mill Dr. Ottawa OH 45875. The employer did not ensure modifications such as a hole in the fork was performed with manufacturer's approval. Employees are required to use the Toyota (model: 42-5FG18 serial #: 42489) forklift to hoist 55 gallon drums using a shackle and strap attached to the fork. Employees are exposed to hazards associated with overloading a forklift and loss of stability.
