29 CFR 1926.651(k)(2):Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees shall be removed from the hazardous area until the necessary precautions have been taken to ensure their safety. a) RM Excavating, LLC located at 5701 Sunbury Road Columbus, OH 43230: On and preceding May 22, 2023, the employer did not ensure that necessary precautions were taken to protect employees working in an excavation when there was evidence of a hazardous situation. A section of the trench face broke off onto the ladder and a section under the driveway became undermined as the project progressed and no additional protective measures were put in place to mitigate the hazards.
