29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) Capital Home Construction DBA Capital Home Improvements, LLC, 107 Dillaye Ave. Syracuse, NY 13206: On or about 5/22/2023, the employer did not ensure two employees engaged in residential roofing activities on an 11:12 and 12:12 pitch roof with a fall distance of approximately 17 feet, were protected by guardrail systems, safety net systems, or personal fall arrest systems.   Capital Home Improvements was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1390125, citation number 1, item number 1 and was affirmed as a final order on 06/20/2019, with respect to a workplace located at 400 Molloy Road, Mattydale, NY, 13211.  Capital Home Improvements was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(10), which was contained in OSHA inspection number 1559648, citation number 2, item number 1 and was affirmed as a final order on 10/25/2022, with respect to a workplace located at 4867 Sherwood Drive, Syracuse, NY 13215.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (0.9 m) above the upper landing surface being accessed:   107 Dillaye Ave. Syracuse, NY 13206:  On or about 5/22/2023, employees were using  portable extension ladders for roof access/egress that were not extended 3-feet above the upper landing surface being accessed.  Capital Home Improvements was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1390125, citation number 1, item number 2 and was affirmed as a final order on 06/20/2019, with respect to a workplace located at 400 Molloy Road, Mattydale, NY 13211.
