29 CFR  1910.28(b)(2)(i): The employer did not ensure that each employee in a hoist area was protected from falling 4 feet (1.2 m) or more to a lower level by one of the systems listed in 29 CFR 1910.28(b)(2)(i)(A) through (C):   (a) Mezzanines - Employees, working from mezzanines, removed chains, opened gates, or removed guardrails to land materials onto the mezzanines and to load materials for lowering from the mezzanines.  While working at the mezzanine hoist access opening, an employee had no guardrail system, personal fall arrest system, or travel restraint system, for protection from falling 11 feet 3 inches to grade, on or about May 18, 2023.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.132(c): Personal protective equipment was not of safe design and construction for the work to be performed:  (a) Warehouse 1 - The employer provided the employee, who operated the Yale order picker, model OS030EFN24TE085, serial number D801N04322N, with a personal fall arrest system that included a lanyard with  shock pack, while elevated on order picker platform, exposing the employee to the hazard of falling from the order picker platform to a lower level, on or about May 17, 2023.   The operating manual for the order picker specified using a harness and tether line (i.e., personal fall restraint).  No abatement certification or documentation required.

29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a) Bowlers' Supply, Inc., 2187 Pennsylvania Avenue, York, Pennsylvania - The employer did not provide training and evaluation on powered industrial trucks as required by the standard to all employees who the employer permitted to operate powered industrial trucks, such as the TCM sit-down rider forklift, the Yale stand-up rider reach truck, and the Yale order picker, exposing employees to hazards including, but not limited to, tipping of a powered industrial truck, struck-by a powered industrial truck, and falling from a powered industrial truck, on or about May 17, 2023. 29 CFR  1910.178(m)(3): Unauthorized personnel were permitted to ride on industrial trucks:   (a) Bowlers' Supply, Inc., 2187 Pennsylvania Avenue, York, Pennsylvania - Employees rode on the forks, on a pallet on the forks, and in a parts basket on the forks of the TCM sit-down rider forklift and the Yale stand-up rider reach truck, to access Mezzanine 4 and to access upper level shelves of metal storage racks, exposing the employees to hazards, including falling to a lower level and to getting caught in moving parts of the powered industrial trucks, on or about March 2023.  Abatement certification required within 10 days after abatement date. (a) Bowlers' Supply, Inc., 2187 Pennsylvania Avenue, York, Pennsylvania - On or about January 3, 2023, the employer did not record the following workplace injuries on the OSHA Form 300, or equivalent, for calendar year 2023:  While stacking boards in a truck, the boards fell over onto an employee's ankle, resulting in a right ankle fracture with 18 days away from work.   While stacking boards in a truck, the boards fell over, onto an employee's leg, resulting in a left tibia fracture with 69 days away from work and 21 days of restricted work activity.  While stacking boards in a truck, the boards fell over, causing an employee to trip, resulting in left knee and left finger injuries with 8 days of restricted work activity.  No abatement certification or documentation required.
