29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a) Worksite, 50 Forrest Avenue, Glenn Cove, NY, 11542- Employees were constructing an awning over a wood patio measuring approximately 8 feet 8 inches in height. Employees were working on an unprotected edge without the use a guardrail system, safety net system, or a personal fall arrest system; on or about May 24, 2023.   Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) Worksite, 50 Forrest Avenue, Glenn Cove, NY, 11542- Employees were exposed to falling while installing a metal awning approximately 8 feet above the ground. Employees were not trained to recognize hazards associated with falling; on or about May 24, 2023.    Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed  a) Worksite, 50 Forrest Avenue, Glenn Cove, NY, 11542- Employee were installing metal framing for an awning on top of a wood patio measuring 8 feet 8 inches from the ground. Employees utilized a 16-foot Louisville extension ladder to gain access to the top of the patio. The extension ladder extended one foot above the landing; on or about May 24, 2023.  Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
