29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) At 10591 Aria Court, Lot 9 Verandas Estates (Front of House), Fairhope, Alabama: On May 24, 2023; the employer allowed his employees to use an extension ladder to gain access to the roof and the rails of the ladder did not extend three feet above the ladder landing to provide safe access exposing his employees to a fall hazard of 12 feet 3 inches to the ground below. b) At 10591 Aria Court, Lot 9 Verandas Estates (Rear of House), Fairhope, Alabama: On May 24, 2023; the employer allowed his employees to use an extension ladder to gain access to the roof and the rails of the ladder did not extend three feet above the ladder landing to provide safe access exposing his employees to a fall hazard of 12 feet 9 inches to the ground below.

The Victoria Quiahua Florres dba Victoria Quiahua Florres was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1619508, citation number 1, item number 1and was affirmed as a final order on November 22, 2022, with respect to a workplace located at 301 State Street Unit 7, Mobile, Alabama.
