29 CFR 1926.501(b)(13): Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): (a)Cowboy Roofing & Construction, LLC at 6100 South Vineyard Avenue, Sioux Falls, SD 57108: On or about and at times prior to May 23, 2023, the employer did not ensure that employees were protected from fall hazards, in that employees were conducting roofing and gutter installation operations on a 4:12 pitch, multi-story residential property without the use of a fall protection system. This condition exposed employees to fall hazards greater than six feet. Cowboy Roofing & Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1635690, citation number 1, item number 2, and was affirmed as a final order on April 7, 2023, with respect to a workplace located at 6908 West 8th Street, Sioux Falls, SD 57107.
