29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system:  On or about May 23, 2023 the employer did not ensure that employees who were engaged in residential construction activities were protected from fall hazards.   Employees were exposed to falls of in excess of 10 feet to the ground below while performing roofing activities.  The workers were actively engaged in residential roofing activities while only part of the workers were utilizing fall protection.  Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  On or about May 23, 2023 the employer failed to ensure the ladder used to access and egress the residential roof was 3 foot above the landing edge.  The ladder that is being used by the employees that were conducting residential roofing activities did not extend 3 feet above the landing edge.  The ladder was not extended past the top roof edge.   The workers were utilizing this ladder to access and egress the work area throughout the day.  Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR  1926.1053(b)(5)(i):Non-self-supporting ladder(s) were not used at an angle such that the horizontal distance from the top support to the foot of the ladder was approximately one-quarter of the working length of the ladder.  On or about May 23, 2023 the employer did not ensure the ladder being utilized was properly setup.  The height of the ladder was approximately 11 feet with the base of the ladder at 8.5 feet away from the wall edge.  This exposes employees engaged in residential roofing activities to falls while accessing and egressing the work area.  Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
