29 CFR 1926.102(a)(1):29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: a) Jobsite, 31 Rycroft Road (Lot #21) Mechanicsburg, PA - On or about May 24, 2023, the employer did not ensure that eye protective equipment was used when employees were exposed to eye injury while using pneumatic nail guns for framing. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): a) Jobsite, 31 Rycroft Road (Lot #21) Mechanicsburg, PA - On or about May 24, 2023, employees performing residential home construction on a multi level stick built home were exposed to fall hazards of greater than 20 feet from the trusses to grade, employees were not utilizing any means of fall protection. b) Jobsite, 31 Rycroft Road (Lot #21) Mechanicsburg, PA - On or about May 24, 2023, employees performing residential home construction on a multi level stick built home were exposed to fall hazards of greater than 8 feet from trusses to second floor , employees were not utilizing any means of fall protection. c) Jobsite, 31 Rycroft Road (Lot #21) Mechanicsburg, PA - On or about May 24, 2023, employees performing residential home construction on a multi level stick built home were exposed to fall hazards of greater than 8 feet from second floor to the first floor, employees were not utilizing any means of fall protection. d) Jobsite, 31 Rycroft Road (Lot #21) Mechanicsburg, PA - On or about May 24, 2023, employees performing residential home construction on a multi level stick built home were exposed to fall hazards of greater than 15 feet from second floor to the exterior dumpster, employees were not utilizing any means of fall protection. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
