29 CFR  1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.  a. Located at 4999 Wind Crest Ln, Grove City, OH 43123: On or about May 25, 2023,  the employer did not ensure that employees were protected from fall hazards of approximately 23- feet. The employees were on a pump jack scaffold performing siding work on an under-construction residential home.

29 CFR  1926.454(a):The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:  a. Located at 4999 Wind Crest Ln, Grove City, OH 43123: On or about May 25, 2023, employees performing work  from a pump jack scaffold were no trained by a qualified person on how to identify fall hazards and falling object hazards, the procedures for erecting and maintaining fall protection systems, and procedures for erecting and maintaining the scaffolding and proper use of the scaffold. The employees were on a pump jack scaffold performing siding work on an under-construction residential home. The scaffold platform was setup at an angle and without a complete fall protection system which exposed employees to fall hazards of approximately 23 feet.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. Located at 4999 Wind Crest Ln, Grove City, OH 43123: On or about May 25, 2023, the employer failed to ensure that an employee was protected against fall hazards of approximately 23 feet. The employee was installing ridge caps on the shingle roof of an under-construction residential home without any form of fall protection.

One employee was installing ridge caps on the shingle roof at heights exceeding 23 feet without being trained on fall hazards or procedures to be followed in order to minimize fall hazards.

29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a. Located at 4999 Wind Crest Ln, Grove City, OH 43123: On or about May 25, 2023, the employer failed to ensure extension ladders were extended 3 feet above the upper landing, or had their top secured to a rigid support with a grasping device, exposing an employee to fall hazards of approximately 23 feet. The employee was using a 24-feet and a 13-feet extension ladders to access to roof to install ridge caps on the shingle roof of an under-construction residential home.
