29 CFR  1926.100(a):Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  a. Location at 417 Conor's Pass Lot 3574, Newark Ohio 43055: On or about May 24, 2023 an employee was exposed to overheard hazards without head protection while working underneath two framers that were installing loose framing material while using a pneumatic nail gun and hand tools.

29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. Location at 417 Conor's Pass Lot 3574, Newark Ohio 43055: On or about May 24, 2023, employees were using pneumatic nail guns without any eye protection, thereby exposing the employees to struck by hazards to the eyes.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. Location at 417 Conor's Pass Lot 3574, Newark Ohio 43055.: On or about May 24, 2023 employees were performing framing work at a new build single-story home without any type of fall protection in place which exposed the employees to falls of approximately 8 feet 11inches to the ground below.

29 CFR  1926.1053(b)(16):Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, shall either be immediately marked in a manner that readily identifies them as defective, or be tagged with "Do Not Use" or similar language, and shall be withdrawn from service until repaired.  a. Location at 417 Conor's Pass Lot 3574, Newark Ohio 43055.: On or about May 24, 2023: The employer failed to ensure the portable ladders were free from any faulty or defective components which exposed the employees that utilized the ladders to fall hazards of up to 8 feet 11 inches to the ground below.

Equipment found damaged or defective shall not be used until repaired.  a. Location at 417 Conor's Pass Lot 3574, Newark Ohio 43055.: On or about May 24, 2023: the employer failed to ensure the microwave and circular saw cords/plugs were inspected before use thereby exposing the employees to 120 volt electrical shock hazards.
