This condition exposed employees to fall hazards greater than six feet.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use: (a)Barrick Construction LLC at 1801 North Cavalier Avenue, Sioux Falls, SD 57107: On or about and at times prior to May 25, 2023, the exposing employer did not ensure employees were protected from serious injury while using of an elevated work platform which was not designed, constructed, or used in accordance with the requirements of the rough terrain forklift manufacturer. Employees utilized the platform to set trusses, store material and access a two story dwelling roof on a multi-family duplex home under construction. The platform was not specifically approved by the forklift manufacturer nor did it meet ANSI/ITSDF B56.6-2021 requirements. The employer did not ensure that the rough terrain forklift ("RTFL") was approved by the manufacturer for such use, as well as ensuring that the truck was equipped with the proper information plate or load capacity chart when used for the lifting of personnel. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that all platforms used for elevating personnel with a rough terrain forklift truck comply with the design requirements specified in ASME/ITSDF B56.6-2021, American Society of Mechanical Engineers/Industrial Truck Standards Development Foundation, "Safety Standards for Rough Terrain Forklift Trucks", Section 2, paragraph 5.17 Elevating Personnel, as well as Section 3, paragraph 8.24, Personnel Work Platforms for Elevating Personnel. The ANSI/ITSDF B56.6-2021 standard can be obtained by contacting the American National Standards Institute, 1899 L Street, Northwest, 11th Floor, Washington, DC 20036.
