29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. Location at 1961 Glassboro Street Newark, Ohio 43055: On or about May 25, 2023: Employees were not provided with and/or utilizing eye protection when exposed to struck by hazards to the eyes. Two employees were seen operating pneumatic nail guns to install roof shingles on the residential one-story single-family home without wearing any type of eye protection. Thereby exposing the employee to struck by hazards to the eyes and face from flying particles.

29 CFR  1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.   a. Located at 1961 Glassboro Street Newark, Ohio 43055 : On or about May 25, 2023, the employer failed to provide employees with any fall protection training programs for the recognition of fall hazards and procedures to be followed to minimize these hazards, thereby exposing employees to fall hazards of up to 22 feet.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. Located at 1961 Glassboro Street Newark, Ohio 43055: On or about May 25, 2023, Employees engaged in construction work near unprotected edges more than 6 feet above the lower level were not protected from falls. Three employees were observed installing roofing shingles without any form of fall protection thereby exposing the employees to falls of up to approximately 22 feet.   Jose Edulfo Hernandez was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1612067, citation number 1, item number 2 and was affirmed as a final order on November 29, 2022, with respect to a workplace located at Lot# 26, Zander Way, Lewis Center, Ohio 43035.

29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. Location at 1961 Glassboro Street Newark, Ohio 43055: On or about May 25, 2023: the employer did not initiate and maintain a safety and health program to ensure the detection of hazards and the correction of these hazards were done when the employees conducted roofing work for the new build one story single family home. The employees were exposed to falls of up to approximately 22 feet to the ground below.  Jose Hernandez was previously cited for a violation of this occupational safety and health standard 1926.20(b)(1) , which was contained in OSHA inspection number 1612067, citation number 1, item number 1 and was affirmed as a final order on November 29, 2022, with respect to a workplace located at Lot# 26, Zander Way, Lewis Center, Ohio 43035.
