29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a. A nail gun worker in the Team B and C section was exposed to a noise dose of 89.0%, or an equivalent dBA of 89.1 dBA, which was capable of causing permanent hearing loss. The sampling was performed for 450 minutes during one shift on June 1, 2023. The employer did not have a continuing, effective hearing conservation program.

29 CFR 1904.41(a)(2): The establishment had 20 or more but fewer than 250 employees at any time during the previous calendar year, and the establishment was classified as an industry listed in appendix A to subpart E of this part, but did not electronically submit information from OSHA 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee. The employer did not submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the form: a. Superior Sheds, Inc. located at 2323 S Volusia Ave, Orange City, FL: On or about May 25, 2023, and times prior thereto, the employer failed for calendar year 2022, to electronically submit information from the OSHA Form 300A or equivalent by 03/02/2023. The establishment employed approximately 98 employees and was classified in the North American Industrial Classification System as 332311 during calendar year 2022.
