29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) 3865 Buchanan Trail W, Greencastle, PA - Wood Cutting Operations - On or about June 13, 2023, the employer did not institute a continuing and effective hearing conservation program when employees' nose exposure exceeded an 8 hour time weighted average sound level of 85 dBA. A) Quest Technology Edge 5 dosimeter (Serial # EST080227) placed on an employee conducting wood cutting/lumbering operations was exposed to noise at a level of 83.8% of the allowable limit during a 455 minute sampling period on June 13, 2023; exposure calculations included a zero increment for the 30 minutes not sampled. This exposure is equivalent to a sound level of 88.9 dBA for the dose and time of the employee exposure. B) Quest Technology Edge 5 dosimeter (Serial # EST080228) placed on an employee conducting wood cutting/lumbering operations was exposed to noise at a level of 156.4% of the allowable limit during a 445 minute sampling period on June 13, 2023; exposure calculations included a zero increment for the 30 minutes not sampled. This exposure is equivalent to a sound level of 93.4 dBA for the dose and time of the employee exposure. C) Quest Technology Edge 5 dosimeter (Serial # EST080229) placed on an employee conducting wood cutting/lumbering operations was exposed to noise at a level of 60.25% of the allowable limit during a 455 minute sampling period on June 13, 2023; exposure calculations included a zero increment for the 30 minutes not sampled. This exposure is equivalent to a sound level of 86.5 dBA for the dose and time of the employee exposure. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
