29 CFR  1910.23(c)(11): Portable ladders used to gain access to an upper landing surface have side rails that extend at least 3 feet (0.9 m) above the upper landing surface (see Figure D-1):   a) 1709 East Lebanon Road, Dover, DE 19901: On or about 5/24/2023, employees used portable ladders that did not extend at least three feet above the upper landing to work on the roof.  This exposed workers to fall hazards due to an improperly placed ladder. CSHO observed the ladder placed next to the wall of the restaurant with only one rung  over the wall to gain access to the working area.

29 CFR  1910.29(b)(1): The employer did not ensure that  guardrail systems met the requirement that the top edge height of top rails, or equivalent guardrail system members, that are 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface. The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D-11 of this section):  a) 1709 East Lebanon Rd., Dover, DE 19901: On or about 5/24/2023, employees observed conducting service work on air conditioning unit on the roof of the facility near the edge/parapet wall. Employees were exposed to hazards including but not limited to falls of approximately 18 feet and where the parapet measured 14 inches with no top rail with the employees working in immediate proximity and up to 6 feet or less away from the edge.
