29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) Facility: On or about May 24, 2023: an employee in the grinding/finishing area was exposed to continuous noise at a level of 100.3% (equivalent to an 8 hour TWA of 90 dBa) which is approximately 2.5 times the action level for a 10-hour workday of 40% (equivalent to an 10 hour TWA of 83.4dBa) and the employer did not administer a continuing, effective hearing conservation program. Sample taken over 480 minutes. b) Facility: On or about May 24, 2023: an employee in the main welding and fabrication area was exposed to continuous noise at a level of 85.3% (equivalent to an 8 hour TWA of 88.8 dBa) which is approximately 2.13 times the action level for a 10-hour workday of 40% (equivalent to an 10 hour TWA of 83.4dBa) and the employer did not administer a continuing, effective hearing conservation program.
