OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the struck-by or crushing hazards when operating a forklift without the use of a restraint device: (a) On May 30, 2023; and at times prior, employees operated the Hyster model H80FT, S/N S005V05160N without the use of a an operable personal restraint system.
