29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) Jobsite located at or near National Drive, Lot 130, Downingtown, PA 19335 - On or about May 30, 2023, the employer did not ensure that each employee performing work in the trench approximately 5.5 feet deep was instructed to recognize and avoid unsafe conditions applicable to his environmental in order to control or eliminate cave-in hazards or other exposures to illness or injury. b) Jobsite located at or near National Drive, Lot 126, Downingtown, PA 19335 - On or about May 30, 2023, the employer did not ensure that each employee performing work in the trench approximately 6 feet deep was instructed to recognize and avoid unsafe conditions applicable to his environmental in order to control or eliminate cave-in hazards or other exposures to illness or injury.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person prior to the start of work, or as needed throughout the shift, for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: a) Jobsite located at or near National Drive, Lot 130, Downingtown, PA 19335 - On or about May 30, 2023, the employer failed to ensure that an inspection of the excavation, adjacent area, and protective system were made by a competent person prior to the start of work for evidence of a situation that could result in possible cave-ins or other hazardous conditions. Employees were performing excavations to locate the water and sewer line laterals without a designated competent person to inspect the excavation and determine if protective system are needed, thereby exposing employees to cave-in hazards. b) Jobsite located at or near National Drive, Lot 126, Downingtown, PA 19335 - On or about May 30, 2023, the employer failed to ensure that an inspection of the excavation, adjacent area, and protective system were made by a competent person prior to the start of work for evidence of a situation that could result in possible cave-ins or other hazardous conditions.
