29 CFR 1910.9 (b):   Training. Standards in this part requiring training on hazards and related matters, such as standards requiring that employees receive training or that the employer train employees, provide training to employees, or institute or implement a training program, impose a separate compliance duty with respect to each employee covered by the requirement. The employer must train each affected employee in the manner required by the standard, and each failure to train an employee may be considered a separate violation.  On or about May 26th , 2023, at 6089 Taylor Road, Naples, Florida, an employee was exposed to struck-by and crushing hazards while guiding a forklift operator during the movement of a slab and walking/standing between a natural stone slab and a powered industrial truck.

29 CFR  1910.136(a): The employer did not require employees to use protective footwear when employees' feet were exposed to foot injuries due to falling or rolling objects, or objects piercing the sole, or when the use of protective footwear will protect the affected employee from an electrical hazard, that remains after the employer takes other necessary protective measures:  On or about May 26th , 2023, at 6089 Taylor Road, Naples, Florida, an employee was exposed to struck-by and crushing hazards when the use of protective footwear was not required by the employer while guiding a forklift operator during the movement of a slab and walking/standing between a natural stone slab and a powered industrial truck.

29 CFR  1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not provided to the operator when the operator has been involved in an accident or near-miss incident:  On or about June 1st, 2023, at 6089 Taylor Road, Naples, Florida, employees were exposed to struck-by and crushing hazards when a powered industrial truck operator was driving a forklift without receiving refresher training after the operator had been involved in an accident.
