29 CFR 1910.132(a): Protective equipment was not used, when necessary, whenever hazards capable of causing injury and impairment were encountered: (a) At the front of the facility at 3719 N Peachtree Rd. Atlanta, GA: On or about June 1, 2023, workers engaged in felling a tree with a chainsaw, were not provided chaps or other equipment to protect their lower extremities from laceration and amputation hazards, or eye protection to shield their eyes from debris projectiles.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment (PPE). If such hazards were present, or likely to be present, the employer did not: (i) Select, and have each affected employee use, the types of PPE that would protect the affected employee from the hazards identified in the hazard assessment; (ii) Communicate selection decisions to each affected employee; and (iii) Select PPE that properly fit each affected employee: (a) At the front of the facility at 3719 N Peachtree Rd. Atlanta, GA: On or about June 1, 2023, employees engaged in felling a tree with a chainsaw, were exposed to severe eye injuries, cut/laceration, amputation, struck-by, crushing, and fall hazards, in that the employer did not conduct an assessment to determine the appropriate personal protective equipment for employees to use.
