29 CFR  1910.134(c)(1):In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable:  a) On or about May 1, 2023, the employer did not establish and implement a written respiratory protection program for employees required to wear a 3M 8511 FFR N-95  or 3M 07192 tight fitting Dual cartridge respirators while working at the parts cleaning tank or spraying bed liners.

The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. 29 CFR  1910.243(c)(3):Vertical portable grinders. Safety guards used on machines known as right angle head or vertical portable grinders shall have a maximum exposure angle of 180 deg., and the guard shall be so located so as to be between the operator and the wheel during use. Adjustment of guard shall be such that pieces of an accidentally broken wheel will be deflected away from the operator. (See Figure P-4.)   a) On or about May 16, 2023, the employer did not ensure vertical portable grinders were guarded in that employees were using a 20V Bauer Cordless grinder and a Metabo Corded grinder without guards.
