29 CFR 1910.28(b)(7): The employer did not ensure that each employee on a walking-working surface near an opening, including one with a chute attached, where the inside bottom edge of the opening is less than 39 inches (99 cm) above that walking-working surface and the outside bottom edge of the opening is 4 feet (1.2 m) or more above a lower level is protected from falling by the use of one of the systems listed in 29 CFR 1910.28(b)(7)(i)-(iv).   a)  At 2 Brampton Road, Garden City, GA 31408, on or about June 1, 2023, and at times prior to, the employer exposed employees to fall hazards of 52 inches in that there were not guards in place to prevent employees from falling when the wells were empty.
