29 CFR 1910.178(p)(1): Powered industrial trucks were found to be in need of repair, defective, or unsafe and were not taken out of service until they had been restored to safe operating condition. On or about 06/06/2023, the employer had not ensured any powered industrial truck which was found to be in need of repair, defective, or in any way unsafe, was removed from service. The following powered industrial trucks were in use and not removed from service: a) Toyota Forklift model 8FGU25 was defective at the time of the inspection. Two brake pads were missing exposing bare metal. b) HELI Forklift model CPC025-KU11 was defective at the time of the inspection. The horn and seatbelt were each not operable.

On or about 06/02/2023 the employer had not ensured that each powered industrial truck was pre-inspected for safety compliance prior to use. The following powered industrial trucks were being operated for several months with unsafe conditions: a) Toyota propane model 8FGU25 had two missing brake pedal covers with bare metal exposed. b) HELI diesel model CPC025-KU11 had a non-functioning horn and seatbelt.
