29 CFR 1926.451(c)(2)(v): The employer used forklifts to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied: Note: Preamble to Subpart L promulgated new paragraph (c)(2)(iv) & (v) in final rule to provide guidance. Added provision requires that in the case of fork-lifts, the entire scaffold platform be secured to the forklift. a. 20 Livingston St., Newark, NJ - The employer did not ensure that a working platform attached to a JCB 510-56, Telescopic Handler, was secured to the forks. Employees engaged in the delivery of appliances, that included, but was not limited to refrigerators, washers, dryers, dishwashers, and microwaves, to the second level of a multi-unit residential building entered the work platform to unload appliance where the platform was not fully secured to the forks and carriage. Violation occurred on or about June 3, 2023

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a. 20 Livingston St., Newark, NJ The employer did not ensure that employees were protected from falls. Employees engaged in the delivery of appliances, that included, but was not limited to refrigerators, washers, dryers, dishwashers, and microwaves, to the second level of a multi-unit residential building were not using any means of fall protection while guiding a JCB 510-56, Telescopic Handler, up to the building to unload the appliances.. Violation occurred on or about June 3, 2023
