Also employer did not comply  with Additional Abatement per Formal Settlement Agreement agreed to and signed on 8/16/2024; case was contested on 12/29/2023 and settled with a Formal Settlement Agreement and in accordance with agreement, employer was required to provide additional abatements and Abatement was due by 10/31/2024.

29 CFR1926.703(a)(1):  Formwork shall be designed, fabricated, erected, supported, braced and maintained capable of supporting without failure all vertical and lateral loads that may reasonably be anticipated to be applied to the formwork.  188 Lafayette Street, New Haven, CT: On or about June 2, 2023, the employer did not ensure the formwork supports were designed, erected, and capable of supporting the loads applied to the formwork resulting in the collapse of the formwork and supports.  Eight employees performing tasks such as (but not limited to) concrete work about three levels of shoring and re-shoring required rescue and five were hospitalized following the collapse.
