29 CFR 1910.95(i)(1): The employer did not replace hearing protectors available to all employees exposed to an 8-hour time-weighted average of 85 decibels or greater at no cost to the employees: (a) Facility wide - On or about March 31, 2023, the employer exposed employees to noise levels in excess of 85 dBA 8-hour time weighted average (TWA) while processing chicken in various stages without providing the employees with hearing protection free of charge.
