29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not provided to the operator when the operator has been involved in an accident or near-miss incident: a. Cooler Area, on or about June 6, 2023, and at times prior, employees were exposed to struck by hazard. Employee was not provided refresher training after being involved in forklift incidents, near misses and other unsafe acts. The employee was required to continue to operate the forklift without being retrained in the relevant topic.

29 CFR 1910.178(n)(6): Industrial truck drivers were not required to look in the direction of, and keep a clear view of the path of travel: On or about June 6, 2023, at the cooler area located at 220 Southern Empire Rd, Shady Dale, GA: Two employees operating the Raymond pallet jack truck in the forward motion, did not look in the direction of travel for clear view of his path of travel exposing employees working in the area to struck-by hazards.
