29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: (a) On or about June 6, 2023, the employer did not ensure that employees were protected from injury in that six employees removing and installing shingles on a two-story commercial property, with a roof pitch of approximately 4-in-12, were not utilizing a fall protection system. This condition exposed employees of approximately 17 feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) On or about June 6, 2023, the employer did not ensure that extension ladders had side rails extending 3 feet above the roof edge when employees were mounting the roof from ground level in that the ladder only extended 2 feet. Employees exited the extension ladders and climbed onto the roof. This condition exposed employees to fall hazards of approximately 17 feet to the ground below.
