29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration: Such activities were not performed only by experienced and trained employees selected for such work by the competent person:  (a) On and before June 7, 2023, the employer did not ensure that a fabricated tube frame scaffold was erected with the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling, or alteration.  Employees and the company owner, worked on the second and third level of the fabricated tube frame scaffold which was missing end-rails and mid-rails both on the exterior and interior of the scaffold, improper and missing planking on all three levels, missing mud seals and no ladder for access.  This condition exposed employees and the owner to a fall of approximately 15 feet.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii):  (a)	On and before June 7, 2023, the creating and exposing employer did not ensure that a fabricated tube frame scaffold was erected with multiple levels of the scaffold not being fully planked while employees worked form the third level. This condition exposed employees and the owner to a fall of approximately 15 feet.  (b)  On and before June 7, 2023, the creating and exposing employer did not ensure that a fabricated tube frame scaffold was erected with multiple levels of the scaffold not being fully planked while employees worked form the second and third level. This condition exposed employees and the owner to a fall of approximately 15 feet.

29 CFR 1926.451(b)(10): Scaffold components manufactured by different manufacturers shall not be intermixed unless the components fit together without force and the scaffold's structural integrity is maintained by the user. Scaffold components manufactured by different manufacturers shall not be modified in order to intermix them unless a competent person determines the resulting scaffold is structurally sound.  (a)	On and before June 7, 2023, the employer did not ensure that employees were protected from a fall from elevation while working on the third level of the fabricated tube frame scaffold in that end-rails and mid-rails, both on the exterior and interior of the scaffold, were not installed and no personal fall arrest systems were worn by employees.  This condition exposed employees and the general contractor to a fall of approximately 15 feet.  (b) On and before June 7, 2023, the employer did not ensure that employees were protected from a fall from elevation while working on the second and third level of the fabricated tube frame scaffold in that end-rails and mid-rails, both on the exterior and interior of the scaffold, were not installed and no personal fall arrest systems were worn by employees. This condition exposed employees and the general contractor to a fall of approximately 15 feet.  (b)	On and before June 7, 2023, the employer did not ensure that employees were protected from a fall from elevation while working on the second and third level of the fabricated tube frame scaffold in that mud seals and base plates were not used on scaffolding which was not properly erected or supported by a certified, qualified or competent person. 29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Cross braces were used as a means of access by employees:  (a)	On and before June 7, 2023, the employer did not ensure that employees were protected from a fall from elevation while working on the third level of the fabricated tube frame scaffold in that no ladder access was provided on scaffolding which was not properly erected or supported by a certified, qualified or competent person.  This condition exposed employees and the general contractor to a fall of approximately 15 feet.
