29 CFR 1910.28(b)(1)(i): Unprotected sides and edges. Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling.  On or about June 7, 2023 the employer failed to protect the edge of an elevated platform employees use to get on top of the tanker truck and place a cleaning rod inside of the tank to clean milk and other dairy products from the inside of the tank. Employees working on the platform are exposed to an unguarded edge that leads to a fall hazard of approximately twelve and a half feet (12.5 ft.) onto the concrete ground below or the inside of a tanker truck.

29 CFR  1910.1200(e)(1): The employer failed to develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified on labels and other forms of warning, safety data sheets, and employee information and training will be met.  On or about June 7, 2023 the employer failed to develop and maintain a written Hazard Communication (HAZCOM) program for employees who conduct cleaning operations  for the outside of the tanker truck. The program must include how to train employees on hazardous chemical products used in washing operations and how to identify the different hazards located in the SDS and labels on the containers for products including but not limited to the Zep Morado Super Cleaner 55 GL also known as TNT which contain the chemical products sodium hydroxide and 2-butoxyethanol.

29 CFR  1910.1200(h)(1): Employer failed to provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  On or about June 7, 2023 the employer failed to develop and maintain a written training program for employees that handle hazardous chemical products for tanker truck cleaning operations that include the chemical products of sodium hydroxide and 2-butoxyethanol. The employees are responsible for using the chemical cleaning product Zep Morado Super Cleaner 55 GL in truck washing operations using a hand pump sprayer as part of the process of washing the outside of the tanker trucks.
