29 CFR 1926.451(f)(7):Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person. a) On or about June 7, 2023, the employer did not ensure that their pump jack scaffold was erected by a competent person, as a result employees were exposed to a 21 ft fall hazard while working from the pump jack.

29 CFR 1926.454(a):The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: (1) The nature of any electrical hazards, fall hazards and falling object hazards in the work area; (2) The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used; (3) The proper use of the scaffold, and the proper handling of materials on the scaffold; (4) The maximum intended load and the load-carrying capacities of the scaffolds used; and (5) Any other pertinent requirements of this subpart a) On or about June 7, 2023, the employer did not ensure employees were adequately trained to recognize and minimize hazards while performing siding work on a pump jack scaffold scaffold.

29 CFR 1926.20(b)(2): Accident Prevention Responsibilities. Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. a) On or about June 7, 2023, employees are exposed to a fall hazard greater than 21 ft as there are no frequent and regular inspections being performed by a competent person on a pump jack scaffolding system to ensure fall protection system such as end rails are installed or personal fall arrest systems are utilized prior to use of the scaffolding system. Klebber Uzcha dba Rescue Roofing/N.S. Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(g)(1), which was contained in OSHA inspection number 1380667, citation number 1, item number 1 and was affirmed as a final order on October 19, 2019, with respect to a workplace located at 1305 Silver Linden Dr Tipp City, OH 45371.

29 CFR 1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part. a) On or about June 7, 2023, employees are exposed to a 21 ft. fall hazard while performing siding work on a residential jobsite on a pump jack scaffold without utilizing a personal fall arrest system or guardrail system when working on the end of scaffold without end rails.
